    California Builders Right To Repair Current Law Summary:

    Current Law Summary: SB800 (codified as Civil Code §§895, et seq) is the most far-reaching, complex law regulating construction defect litigation, right to repair, warranty obligations and maintenance requirements transference in the country. In essence, to afford protection against frivolous lawsuits, builders shall do all the following:A homeowner is obligated to follow all reasonable maintenance obligations and schedules communicated in writing to the homeowner by the builder and product manufacturers, as well as commonly accepted maintenance practices. A failure by a homeowner to follow these obligations, schedules, and practices may subject the homeowner to the affirmative defenses.A builder, under the principles of comparative fault pertaining to affirmative defenses, may be excused, in whole or in part, from any obligation, damage, loss, or liability if the builder can demonstrate any of the following affirmative defenses in response to a claimed violation:

    Ninth Circuit Issues Injunction Halting SB 261 Climate Disclosure Laws

    December 22, 2025 —
    On November 18, 2025, the U.S. Court of Appeals for the Ninth Circuit issued an injunction temporarily halting the implementation of California’s SB 261, the Climate-Related Financial Risk Act, just weeks before the law’s first mandated disclosures on January 1, 2026. The court declined to stay California’s companion climate emissions disclosure bill, the Climate Corporate Data Accountability Act (SB 253), due to that bill’s less immediately pressing compliance deadline of August 2026. Background on California Climate Disclosure Laws As we have discussed in previous posts, California enacted two comprehensive climate disclosure laws in 2023. The Climate Corporate Data Accountability Act (SB 253) and the Climate-Related Financial Risk Act (SB 261) impose greenhouse gas emissions and climate-related financial risk reporting requirements that apply to thousands of public and private companies formed under U.S. law and “doing business in California.” The California Air Resources Board (CARB) has released a preliminary list of companies it believes may be subject to the state’s new climate disclosure regime.     This past Blitz Build season, the Home Builders Foundation (“HBF”) once again brought together builders, tradespeople, volunteer crews, and sponsors from across the Front Range for their signature program: Blitz Build. From May through October, Blitz Build weekends give HBF clients, those living with physical disabilities, access to something many of us take for granted: safe, accessible entries and pathways in their own homes.     Outer Banks Homes Collapsing Is Just a Taste of What’s to Come

    December 22, 2025 —
    On Sept. 20, 2024, a four-bedroom, three-bathroom beach house in Buxton, North Carolina, in the heart of the Outer Banks, sold for $580,000. On Oct. 28 this year, the house, known as Mermaid’s Rest, collapsed into the ocean. It was one of five homes swallowed that day by high waves churned up by an offshore storm. Few things demonstrate how climate change is already upending lives and fortunes quite like watching somebody’s stately vacation home topple into the drink. But Outer Banks houses like Mermaid’s Rest (a striking example first dug up by the New York Times but just one of many such cases), are mere showroom models for the havoc that rising seas are already threatening. First, let’s get one caveat out of the way: Barrier islands like the Outer Banks are always changing shape, regardless of the climate. Homes built on the shores of such islands have always been at risk of eventually sliding off the edge like a quarter in one of those coin-pusher arcade games. Read the full story...

    Cross-Office Team Secures Summary Judgment Win in Negligence Action with $2M Demand

    December 02, 2025 —
    St. Louis, Mo. (October 15, 2025) - St. Louis Managing Partner Tracy Cowan and Kansas City Partner Jonathan Craig secured a summary judgment win in a Missouri negligence action with a $2 million demand. The plaintiff alleged he fell on uncleared ice on the client hotel’s parking lot and sustained a shoulder injury that required significant surgical intervention and loss of use. The Lewis Brisbois team’s aggressive discovery revealed that there was significantly more to the story, including that the plaintiff had made several trips back and forth on the hotel’s allegedly icy parking lot prior to injuring himself.     Tampa Office Secures Summary Judgment for Property Owner Client in Trip-and-Fall Lawsuit

    September 15, 2025 —
    Tampa, Fla. (August 15, 2025) - Tampa Partner Nicholas Dareneau recently obtained summary judgment for a property owner client in a trip-and-fall lawsuit, with a Florida judge finding that the condition of the sidewalk over which the plaintiff tripped was not dangerous as a matter of law. The incident in question occurred in December 2022, as the plaintiff was walking to the entrance of a retail store on the client's property. She stepped up onto the sidewalk, walked across pavers and then tripped on a section of concrete, suffering injuries. She proceeded to sue Lewis Brisbois’ property owner client and the store in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County. Ultimately, the plaintiff dropped the store owner from the lawsuit. Read the full story...

    Backpacks, Broadway, and Building Restrictions: A Legal Reminder

    September 15, 2025 —
    A few weeks ago, I took two of my girls to New York City for a quick overnight trip to see two Broadway shows. My rule for packing was simple: one backpack each. No rolling bags, no extras. We were walking the city, checking into a hotel, and going straight to the shows. The plain meaning of my instructions were clear: one bag per person. That’s exactly how the Tennessee Court of Appeals handled a recent case, Killen v. Boardman (Aug. 2025). A landowner tried to build a second house after subdividing her lot. But the subdivision restrictions, recorded in 1971, said: "Not more than one residence shall be erected on one tract." The court enforced the restriction as written. One tract meant one residence. Splitting the lot didn’t erase the covenant or the developer’s plan for the subdivision. What made the analysis significant was the court’s reliance on the general plan doctrine, which holds that that when developer sells land with restrictions designed to implement a general plan of development, he “impliedly represents to the purchasers that the rest of the land included in the plan is, or will be, similarly restricted.” Read the full story...

    Texas Restricts Foreign Ownership of Real Property

    November 09, 2025 —
    Houston, Tex. (October 9, 2025) - Effective September 1, 2025, certain foreign individuals and entities are no longer able to purchase or acquire an interest in real property in Texas. Governor Abott signed Senate Bill 17 into law on June 20, 2025, amending Chapter 5 of the Texas Property Code to add Subchapter H. The new legislation targets governmental entities of and companies, organizations, and individuals from “designated countries,” which Subchapter H defines as countries that the U.S. Director of National Intelligence identifies as posing a risk to United States national security, or additional countries that the governor designates after determining that the purchase or acquisition poses a risk to national security. Subchapter H initially designates China, Russia, Iran, and North Korea as posing such risk. “Companies” and “organizations” collectively include not only associations, corporations, partnerships, and limited liability companies, but real estate investment trusts, joint ventures, insurance companies, and non-profit organizations.
